| 摘 要： | 意思自治原则是民法中的一项重要原则 ,在实现法律对民事社会关系的调整过程中发挥着重要的作用。但是该原则的适用不是不受限制的、任意的 ,而是有其特定的适用范围的 ,只有在满足特定的条件的情况下 ,该原则才能够发挥其相应的作用 ,超出了特定范围、不符合特定的条件 ,就没有该原则发挥作用的余地

| Abstract: | The rule of autonomy of the will is an important rule in civil law, and has played important roles in the process of realizing legal adjustment in civil social relationships. However, the application of the principle is not without limitations and arbitrary, but has its specified application sphere. Only certain conditions are satisfied, the principle can exert its influence. There would be no room for the principle to exert its function if it goes beyond a certain sphere or cannot satisfy certain condition. |
