基于社会资本解释范式的刑事政策研究

社会资本理论为刑事政策研究提供了新的解释范式,有着重要的方法论意义。社会资本是资本的一种表现形式,是一种嵌入在社会网络中的资源。社会资本与刑事政策之间存在着密切关系:宏观而言,社会资本存量与控制犯罪效果成正比;微观而论,不同形式的社会资本对犯罪生成会产生不同的影响,进而影响到相应的刑事政策。因此,从社会资本角度来反思和发展我国现行刑事政策有着重要的理论和实践价值。

A Study on Criminal Policy based on Social Capital Interpretational Mode

Social capital theory provides a new interpretation paradigm for criminal policy research and has an important significance of the methodology. Social capital is a form of capital embedded in a social network. There is a close relationship between Social Capital and criminal policy: The social capital storage quantity and the effect of crime controlling are proportional in the macroscopic angle; the different forms of social capital may have different influences to the crime occurrence in the microscopic angle, thereby affecting the corresponding criminal policy. Therefore, it has an important theoretical and practical value to reflect and develop the current China's criminal policy from the perspective of social capital theory.
