| 摘 要： | 随着中国法理学逐渐摆脱幼稚,作为表征学术成熟产物的法律解释也经历了一个转向:从法律文本的简单注解转向以司法适用过程中的规则和事实互动关系为内容的深度阐释。司法实践中的法律解释活动不仅仅是一套将成文法运用到个案的法律技术和方法,在某种程度上也是一种文化与价值的重新认识与选择,文章在先验、经验以及实践三个层面上从本体论角度追问和反思解释主体的法律解释姿态。

| Abstract: | With Chinese jurisprudence society getting rid of infantility, the legal interpretation that is regarded as a symbol of academie maturity is undergoing a turning:from the simple annotation of the legal text to the deep interpretation of interaction of the fact and the rule during the judicatory practice. The action of the legal interpretation not only involves the technology and method of the law,but also reflects the culture and the value. The article discusses the ontological problem of the legal interpretation through three levels: the transcendent, the empiristic and the practical. |
