农民工权益保障问题的法学思考

构建和谐劳动关系,保护农民工合法权益,是近年来我国社会关注的焦点问题之一,同时也是我国构建社会主义和谐社会的重要因素。近年来,侵害农民工合法权益的现象屡见不鲜,农民工的权益得不到合法有效的完善,农民工的权益受损现象日趋突出,成为亟待解决的问题。我们可以通过对农民工的保障权、就业权等权益现状的分析,总结农民工权益受损的表现形式以及通过扩大劳动法的调整范围,明确劳动者的相关权益,明确用人主体的法律资格,完善处理劳动争议的法律制度等法律途径,使得农民工的权益得到合法有效的维护。

Improving the Legal System of the Peasant Labor's Rights and Interests Protection

Structuring harmonious labor relation,and protecting rights and interests of peasant workers,al- ready become one of the hot spot problems and key factors of harmonious society of socialism in China at the same time.On recent years,making inroads on the peasant workers' rights can not be improved effectively;the damage on peasant workers' rights grow obviously;all of these need immediate settlement.The article illustrates the peasant workers' rights and the way that peasant workers being treated,and according to these,finds ways to protect the peasant workers.The ways include setting apart the rights of owner and workers;telling the own- er's qualification;improving the law of dealing with peasant workers and so on.
