司法民主语境中的陪审制度重构

历史久远并延续演化至今的陪审制一直发挥着促进司法民主的重要权能。由于司法民主的精神要旨在不同的历史阶段被赋予语境内涵，从而陪审制也应当根据司法民主的时代精神而进行制度的不断变革和完善。因国度之别和条件差异，作为保障司法民主的陪审制度设计也应因地制宜。当下中国的陪审制应予以保留，但应在该制度的适用范围、方式、陪审员遴选规则及其权利义务等方面进行改革。

Reconstruction of the Jury System in the Context of Democracy of Justice

The jury system of a long history and continuation of evolution so far has been playing an important empowerment to promote the democracy of justice. As the essence of spirit on the democracy of justice aimed at different connotation of context at different stages of history, Jury system should be changed and improved according to the spirit of the times on the democracy of justice. As a result of differences between countries and other differences in conditions, the jury system as for the protection of the democratic jury system should be designed in line with local conditions. The current Chinese jury system should be reserved, it should be reformed in the scope and way of application, the rules of selection of jurors and the rights and obligations, etc.
