牵连犯牵连关系的认定新析

中外刑法理论界对牵连犯牵连关系存在着三种学说,三种学说反映出了牵连关系的一些特征,但未能揭示牵连关系的本质。牵连关系的认定应把握主客观相统一,注重行为之间作用关系的新标准,即主观方面,行为人具有牵连意图;客观方面,方法行为是目的行为的有效方法,结果行为是目的行为的自然结果。

The Determination of the Relations Involved by Implicated Offense

There are three theories which judge implicated relations of implicated offense.But all the theories have defects,thus a new standard to judge implicated relalion s arises which suggests that in subjective aspect of crime ,the offender has crimi nal in tent and in objective aspect of crime ,method act is available act while consequence act is logic consequence.
