| 摘 要： | 通说认为,单位犯罪的处罚原则是以两罚制为主,单罚制为辅。代罚制作为单罚制的一种,规定只处罚直接责任人员,不处罚单位。承认代罚制下存在单位犯罪,会造成理论体系的不统一,也会使作为犯罪主体的单位逃避刑事责任,无法实现刑罚目的。由果溯因,根据罪责自负的原则,采用代罚制的犯罪其实是自然人犯罪,而不是单位犯罪。
