| 摘 要： | 社会危害性是由贝卡利亚首先提出来的，其功能主要在于对刑事立法的限制。社会危害性与罪刑法定并不对立，它们都是以平等、民主和法治信仰为共同基础，二者一起构成限制国家刑罚权的发动、保障人权的两道防线。社会危害性是立法者制定刑法的基础和起点，它在刑法理论中的地位不可替代。

| Abstract: | Social harmfulness was put forward by Beccaria and its function was to regulate criminal legislation. Social harmfulness is not contradictory to the principle of a legally prescribed punishment for a specified crime. They are all based on equality, democracy and legal belief. Social harmfulness is the base and starting point for legislators to make criminal laws and its role in criminal theories is irreplaceable. |
