| 摘 要： | 包庇、纵容黑社会性质组织罪的主体只能是国家机关工作人员 ,其中并不排除国家机关工作人员本身也是黑社会性质组织的成员 ,但对这种情况应具体分析 ,不能一律按包庇、纵容黑社会性质组织罪处理。该罪在主观方面表现为故意 ,且只能是直接故意

| Abstract: | The subject of the crime of harboring a mafia style syndicate can but be personnel of state organs,who themselves are also members of a syndicate in some cases.In handling these cases,one should analyze them case by case,rather than unexceptionally classify them as the crime of harboring.The crime must be committed on purpose. |
