对完善我国反商业贿赂立法的几点建议

在我国的许多行业,商业贿赂已成"行规"和企业运行的潜规则,从业者已陷入恶性竞争的环境.为了惩治和预防商业贿赂行为的发生,维护良好的市场经济秩序,我国应当以法律形式明确界定"商业贿赂"的概念;借鉴国外立法例,加大对商业贿赂行为的处罚力度;拓宽商业贿赂犯罪对象的范围;加快建立企业社会信用体系,营造健康的商业文化.从而遏制商业贿赂蔓延的势头,进一步完善治理商业贿赂的法律法规,建立和规范符合我国国情特点的市场秩序和信用体系.

Legislative Suggestion to Perfect Our Anti-Business Bribe Law

In many professions of our country,the commercial bribe has already been a rule of the circulation of enterprises,the practitioners have already sunk into the environment of unfair competition.In order to prevent the commercial bribe behavior and support the good market economic order,our country should explicitly definite the concept of "commercial bribe" in leagal form;Learn from the foreign lawmaking examples and enlarge the punishment strength of commercial bribe's behavior;Enlarge the scope of the objects of the commercial bribe crime;Speed to build up the social reputation system of enterprises,construct the business culture healthly to suppress the tendency of commercial bribe and furtherly complete the leagal regulations,build up the market order and reputation systems of the state matching with the characteristics of our country.
