涉检上访与规范执法的调查分析

针对当前哈尔滨市涉检上访形势比较严峻的实际情况,通过对若干起典型案件的实证分析,发现执法不规范是导致涉检上访的根本原因。因此,应当加强规范执法机制建设,从源头上遏制涉检上访:建立规范执法意识的培育机制,不断提供规范执法的精神动力;建立规范执法素质的提升机制,筑牢规范执法的本领基础;建立规范执法行为的强化机制,开辟规范执法的实现途径。

A Survey and Analysis of Appeal to the Higher Authorities Referring to the Procuratorial Organs and Canonical Law Enforcement

The fundamental reason for which the appeal to the higher authorities in Ha' erbin has brought high pressure in procuratorial organs is the irregular law enforcement according to a positive analysis to several typical eases.Therefore,the mechanism of law enforcement should be enhanced to reduce the appeal to the higher authorities referring to the procuratorial or- gans from the headstream and following measures should be taken:cultivating the consciousness of canonical law enforcement to provide psychic energy for the prosecutors,improving the capacity of normative law enforcement,and creating the approach of implementation of canonical law enforcement.
