| 摘 要： | 文章对国内外学者关于"推定"的概念、"推定"的分类、"推定"的根据、"推定"的效力等理论上存在的难点进行研究和分析,在推定具有的负面属性或然性、片面性、专断性的基础上,提出推定救济的改进思路,即加强推定的客观影响因素、降低主观因素的制约.

| Abstract: | The author takes primary analysis and study in the theory of pre su mption including: the concept,classification,the basis and the force of presumption.On the basis of analysis to negative attribution of presumption,the author claims that the approach to ameliorating the remedy of presumption is to enhance the effect of objective factors and reduce the effect of subjective factors in it. |
