| 摘 要： | 占有不仅包括动产的公示意义，而且包括对占有人推定的权利意义，同时也是善意取得的重要要件。占有作为事实状态受法律保护的依据欠缺，只有将这种事实状态上升为占有权，才能作为物权法的种类进行定位，同时更有利于其权利的保护：

| Abstract: | Possession has the meaning of personal property＇ s public notification and the owner＇ s presumption rights. At the same time,it is an important document of Bona Fide Acquisition. To be a factual state, possession cannot be protected well by law for the lack of foundation. We should make the possession to be one kind of rights in Real Right Law. That is good for protecting the rights. |
