| 摘 要： | 行贿罪的客观方面——“给予财物”行为之现有立法规定已不能适应刑法惩治新型行贿犯罪行为的需要；从新型行贿犯罪行为以及《联合国反腐败公约》缔结的角度入手，文章认为“给予财物”行为应当修改为“给予不正当好处”行为。
