| 摘 要： | 公正与效率被确定为新世纪人民法院工作的主题。法官在法律所许可的范围内如何尽可能做到人权保障与社会保护的最大平衡———适当地行使自由裁量权 ,文章从法官具备法理学素养的必要性、现实性出发 ,提出了法学教育是提高法官法理学素养的根本途径。
