论刑事案件信息系统

信息可以从主客观两个层面进行理解,客观上的称为原始信息,主观上的称为认识信息。对于侦查主体而言,犯罪过程是原始信息的产生过程,侦查是认识信息的产生过程。同时犯罪和侦查又都可以各自看做一个系统。侦查的过程就是对原始信息进行认识,认识的结果——认识信息与原始信息达到同一的标准是认识的目的。所以,以信息为桥梁,可以将犯罪看做犯罪信息系统,侦查看做侦查信息系统,它们共同构成刑事案件信息系统。

On the Information System of Criminal Cases

Information can be understood from subjective and objective angles. Objectively, we can name information as primitive information, and cognitive information subjectively. To the criminal investigation subject, crime is a process that produces primitive information; the criminal investigation is a process that produces cognitive information. At the same time, the crime and the criminal investigation each can be seen as a system. To investigate is just to understand the primitive information, the goal of which is that the cognitive information and the primitive information are identical. So, taking the information as a bridge, we can regard the crime as the criminal information system, the investigation as the investigative information system, the two of which constitute the information system of criminal cases.
