The Value Analysis of the Jury in the Death Penalty Case

As the most serious case, a death penalty trial will decide lives of citizen. The death penalty trial will be the keystone when we build due process. The article makes value analysis of the jury in the death penalty case. Basing on the philosophic thinking and the positive analysis, the author advices that the jury should be imported into the death penalty trial and a powerful ordinary procedure should be built in the death penalty case. This suggestion will contribute to extend the citizen participant in criminal justice and democratic justice, as well as promote judicial justice and social justice.
