论行政裁量基准的实质渊源——以行政惯例为例

作为一线行政执法经验的总结,行政惯例对行政裁量基准的制定具有引导作用,是裁量基准重要的实质渊源。实践观察显示,行政惯例对裁量基准的制定既具有弥补成文法律规范漏洞、保障相对人信赖利益等正面效应,也具有滋生裁量怠惰、导致行政专横等负面效应。为此,应当通过建立案例指导制度和适度司法审查制度,规范行政惯例对裁量基准的指引。
