| 摘 要： | 特留份制度是现代大部分国家所采用的限制遗嘱自由的主要措施,我国《继承法》虽然有必要的遗产继承份额制度,但存在不足之处。从我国的现实需要来看,应建立特留份制度以完善我国的继承制度。

| Abstract: | Legal Portion system, adopted by most modern countries,is the main measure set to restrict the freedom of testament.Though there are necessary rules and regulations about portion of Estate Succession in Inheritance Law,they are inadequate.To meet the practical needs,it is necessary to set up legal portion system to modify the Inheritance Law in our country. |
