个性化与模式化——对裁判文书写作的思考

裁判文书作为应用文书之一,具有应用文书的共性:格式化或模式化、程式化。但是裁判文书又因其面对各种各样形形色色的具体案件,而陷入难以完全模式化的窘境,这也是近年来要求扭转裁判文书脸谱化局面呼声不断的原因所在。然而,面对效率价值的现实追求,要所有的裁判文书弃模式而求个性显然又是不可能的,实际上,模式化与个性化的冲突,也正是诉讼价值中效率与公正冲突的体现。那么,如何在制作与创作、个性与共性之间把握平衡,显然,是裁判文书写作中一个需要结合价值考虑予以解决的问题。

As one of the practical writing,judicial writing have total characters of the practical writing:standardization.But judicial writing sink into the embarrassing situation that hard complete standardization because it faces various individuation cases always.However,the actuality that pursue the efficiency value,wanting that all judicial writing leave the mode and beg the character is impossible obviously,actually,the conflict between individuation with standardization,is also exactly the conflict of efficiency and fair in the body of litigation value.So,how to balance manufacture with the creations,individuation with standardization,obviously,it is a problem that must be consider litigation value.
