试论公民环境权的生成与合理定位

公民环境权的合理定位与配置 ,对于保障环境法秩序的实现有着重要意义。文章从公民环境权的生成问题入手 ,否定了公民环境权为环境行政权的“衍生形态”或“反射性利益”的错误认识 ,提出公民环境权作为一种人生而应有的权利 ,其法定化将对公民的“偏好”及环境行政权的合理化有重大作用。由此提出公民环境权并非“环境权私权化”的产物 ,而是天然地归属于一种社会性权利 ,这是由环境的物品属性决定的 ,同时也将对其权利的保护与救济产生重大影响。

Discussion on the Evolving and the Reasonable Position of the Civil Environmental Right

To reasonably distribute the civil environmental right and determine the nature of it are very important to realize the sequence of environmental law.The article started with the position of the civil environmental right,denied the wrong conclusions that the civil environmental right is a pattern deriving from the administrative power,and put forward that as a natural right to be legal is important to make the citizens have a special fondness for the right and justify the.administrative power.Therefore,we can draw a conclusion that the civil environmental right is not a pattern of the privatization of environmental right,but a natural social right.This quality is determined by the nature of environment,which can exert a tremendous influence on protecting and relieving the right.
