论行政合同的价值冲突

行政合同既是行政权力广泛干预经济社会的产物 ,又是运用契约形式控制政府权力的手段。权力因素与契约精神的相悖形成了包括行政单向与双向合意之间、行政优先与契约平等之间、依法行政与意思自治之间、合行政目的性与利益交换原则之间的价值冲突。要调解价值冲突就必须加强法律控制 ,强化程序规范 ,加强制度创建 ,适当扩展契约自由的空间 ,平衡经济利益 ,建立行政契约救济制度

On Value Conflict of Administrative Contract

Administrative contract is not only the outcome of administrative power to interfere extensively economic and social affairs,but also a means to control government power by contractual form.The clashes of authority factors and contractual spirit result in a series of conflicts between administrative unilateralism and mutual acceptability,administrative priority and contractual equality,legal principle and meaning autonomy,following administrative goal and conforming principle of interest exchange.The ways to solve these conflicts are to strengthen legal control,intensify procedures restraint,quicken systems building,expand properly space of contractual freedom,balance economic interest and establish system of administrative contractual relief.
