论人大个案监督的政治资源与行动策略

以中国各级人民代表大会在实际政治运作中的地位和作用为出发点,以政治资源及由此产生的政治策略为主要研究视角,将个案监督看作人大的创新性职权行使方式之一,力图探究人大及其常委会在监督司法机关时采用个案监督方式的原因所在。认为,人大及其常委会职能的发挥受到党的领导、社会舆论、宪法及法律规定等3方面的影响,这既限制了人大及其常委会的行动范围,又为其行使职权提供了强有力的支持,从而决定性地塑造着各级人大的行为模式。个案监督就是人大诸多职权行使的新方式之一,集中体现了当前中国人大的行为模式和行为特点。

On the Political Resource and Strategy of Local People Congresses' Implementing Individual Case Supervision

Individual case supervision is a new innovative manner of Local People Congresses' implementing power. Based on the status and function of Local People Congresses in real political activities, this paper is an attempt to find out the reason why Local People Congresses supervise judicial branches in a manner of individual case supervision. By concentrating on the political resource and strategy of Local People Congresses, the analysis shows that Local People Congresses are being influenced by three important factors: the leadership of Chinese Communist Party, public opinion, and constitution and laws, which restrict the scope of Local People Congresses and their committees' activities, provide powerful support and shape the mode of Local People Congresses' activities. After analyzing the logical process of individual case supervision carefully, the paper argues that, for Local People Congresses, individual case supervision based on their political resource is a natural choice and intelligent strategy.
