| 摘 要： | 传统表见代理设置时,没有考虑本人是否有过失。但是,随着社会的发展,社会经济条件和表见代理的成立理由也发生了变化,为了完善我国之表见代理制度,现代表见代理之适用,应该对本人是否有过失给予足够重视。
