| 摘 要： | 全球金融危机的强烈危害性、综合性、规律性分别同现行宽严相济刑事政策的立法理念、运作结构、具体制定存在差异。而全球金融危机又进一步推动了刑罚的宽缓化、凸显了社会多元主体在刑法治理中之重要性,并加速了刑法治理的技术化。通过对立法理念、运作结构、具体制定三方面路径依赖进行调整,该政策便能充分发挥出刑法的社会调控矫正机能。

| Abstract: | The strong hazardness,combination and the regularity of the global financial crisis are different from the legislation idea,operation structure and concrete plan of the criminal legislation policy of combination of strictness and lenience.The global financial crisis improves the lenience of punishment,enhances the importance of social combination bodies in the criminal regulation,and improves the technical of criminal regulation.Through adjusting three aspects including legislation idea,operation structure and concrete plan,it can exert social control function of criminal law. |
