| 摘 要： | 当事人申请调查取证制度在实践运作上呈现程序异化的特点,导致这种现象出现的根本原因在于民事诉讼"庭审—宣判"的双阶结构,缺少审前准备程序。在程序分化基础上实现审判结构"庭前准备程序—庭审程序—宣判"三阶结构变革,才能强化法官的释明权,完善对当事人申请调查取证权的程序保障。

| Abstract: | Alienation appears in the operation system. This reason mainly lies in that the civil p of the party applying for investigating and collecting evidence roceeding lacks the pre-trial procedure. In order to solve the problem, we should build the pre-trial procedure, strengthen the judge＇ s interpretation right and improve the procedural safeguards of the right of the party to apply for investigating and collecting evidence. |
