论我国宪法监督制度的建立与完善——人民检察院参与违宪监督刍议

宪法是国家根本大法，是法治国家法律体系的核心所在。宪法在国家的法律体系中居于最高法律地位。然而我们应该看到由于宪法实施保障制度的不完善。实际生活中“违宪”问题时有发生。特别是那些明显违反宪法的问题得不到纠正，不仅严重地影响了宪法的贯彻实施，而且破坏了我国社会主义民主和法制建设。要充分发挥宪法作用，必须首先完善宪法的运行机制。建立专任的违宪监督机关。对违宪现象予以监督。同时在机构设置、违宪审查方式、违宪审查范围及违宪审查程序方面有充分的法律依据。以形成具有我国特色的社会主义宪法监督体系。

On Establishment and Perfect of Constitutional Supervision System——On participation of People's Procuratorate in Supervision to Unconstitutional Argument

The Constitution is the basic law of a state and the core of the legal system. The Constitution is in the upmost position in the legal norm of a nation. However, we should see that the non-perfect of guarantee system of fulfillment of the constitution, in the real life ＂unconstitutional＂ problems often occurred, especially those obvious constitutional problems have not been rectified. These not only seriously influenced the fulfillment of the constitution, and also break our socialism democracy and legal system construction. To well exert the constitution function well, we should perfect the movement mechanism of the constitution. The supervision of the constitution has an important function to its fulfillment.
