The Public Policy in the Recognition and Enforcement of International Commercial Arbitration Awards

Public policy constitutes an uncertain element in the recognition and enforcement of international commercial arbitration awards,as a result of which the award may be denied recognition and enforcement in a country.The international commercial arbitration committee of the international law association suggested that the concept of international public policy be adopted so that the disadvantage resulting from the different understandings about public policy in different countries in the recognition and enforcement of the awards could be avoided.According to the committee the international public policy in a country includes the fundamental principles pertaining to justice and morality that it wishes to protect,the mandatory rules as well as the international duty it undertakes,and some suggestions about its application is also put forward by the committee.
