当代中国法律职业化路径选择——一个比较法社会学的研究

我国现代司法制度尚处在建立和发展过程中,法律职业化的目标不仅需要依赖法律职业自身的努力,也取决于社会条件及公众认同。基于我国司法体制的特殊性和历史背景,西方社会法律职业及其共同体的历史作用及高度自治不可能在我国重现。针对多层次的法律需求与法律职业单一化、同质化目标的矛盾,需要重新审视我国法律职业化的目标,选择一种接近于大陆法系但具有中国特色的模式与路径。法律职业在接受国家及社会的监督与规制的同时,应积极回应社会与公众的诉求,注重司法独立与司法民主的共同推进,并不断提高自治与自律程度。

Alternatives for Legal Professionalization in Contemporary China A Comparative Legal Sociological Study

Modern judicial system is under construction and development in China. As such, the goals of legal professionalization not only depends on the effort of the legal profession itself but also on the social conditions and public recognition. Based on the specificity and historical background of the judicial system in China, Western legal profession and the historic role and high degree of autonomy of its community cannot be repeated in China. In view of contradiction between the multiple level legal needs and the unification and homogeneous objectives of the legal profession, there is need to review the objectives of legal professionalization in China, making a choice for the civil law mode and path of development with Chinese characteristics. While accepting the state and social supervision and regulation, the legal profession should actively respond to social and public appeals, pay attention to pushing forward both judicial independence and judicial democracy, and to continuously elevate degrees of autonomy and self-discipline.
