欧盟宪法的原则及其意蕴

本文分析了欧盟宪法 (草案 )的基本原则和三个具体原则的内涵、形成过程、相互关系及其运作机制。通过中国宪法与欧盟宪法的比较分析 ,指出欧盟宪法原则的系统性、界分权限及其落实原则时的制度博弈过程 ,对我国政治文明建设的启示。

Principles Underlying the European Constitution and Implications for China

This paper analyzes the principles underlying the European constitution which include the basic Principle,and the concrete principles. It analyzes the meaning and developing history of the principles,and the interrelationship between them. By comparing between the Chinese and European constitution,This paper points out that the systematic of the constitutional principles,the definition and exercise of powers,the results from the games in political life will allow us to have some findings which might give us some inspirations for the civilization of politics in China.
