论我国社会救助应急法治的完善

新冠肺炎疫情发生以来,中央应对疫情领导小组、国务院联防联控机制和有关职能部门,及时发布规范性文件以适应社会救助的紧急需要,扩大了医疗救助的范围,加强了社会救助机构的疫情防控措施,通过下放审批权限、简化救助流程等措施,有效保障了人民群众的生命安全和身体健康,保障了老年人、未成年人、精神病人、流浪乞讨人员、社会贫困人员等社会弱势群体的合法权益,推动了我国社会救助应急法治的发展。我国应当总结新冠肺炎疫情中社会救助应急法治发展的宝贵经验,在相关法律、法规中对重大传染病疫情下医疗救助问题做出特别规定,完善应急状态下社会救助的应急程序规定,加强社会救助机构的疫情防控规定。

The Improvement of Emergency Law on Social Assistance in China

Since the outbreak of the COVID-19 epidemic in China, the Central Leading Group for Response to the Epidemic, the Joint Prevention and Control Mechanism of the State Council and relevant functional departments have issued regulatory documents in a timely manner to meet the urgent needs of social assistance.In the meantime, under the orderly organization of the government, we also expanded the scope of medical assistance and strengthened social assistance institutions Epidemic prevention and control measures. Through measures such as decentralizing approval authority and simplifying the rescue process, the life safety and physical health of the people are effectively guaranteed in China.The legal rights and interests of socially disadvantaged groups such as the elderly, minors, mental patients, vagrants and beggars, and social poor people are also properly protected. In such a situation,our Emergency Law on Social Assistance have been developed a lot. We should summarize the valuable experience in the development of the Emergency Law on Social Assistance during this period: formulating special provisions in relevant laws and regulations on medical assistance in major infectious diseases, improving the emergency procedures for social assistance in emergency situations, as well as refining the epidemic prevention and control regulations of social assistance agencies.
