对“检警一体化”模式的本土化反思

在警察机关与检察机关的侦查关系上，我国学界大部分观点主张应效仿大陆法系国家的做法。实行“检警一体化”，但也有少数派观点否定“检警一体化”。对此，要利用邓正来教授提出的建构“中国法律理性图景”这一分析工具，对“检警一体化”进行本土化的反思。

Considerations on the Integration of Procuratorial Work and Police Investigation

In the investigation relation of public security organs and procuratorial organs, most of scholars maintain that we should follow the example of continental countries in establishing the integration of procuratorial work and police investigation. However, the minority has refuted these views. On my options, we should rethink profoundly the integration of procuratorial work and police investigation through the nativism with analytical means of Chinese Law Rational Prospect advanced by Professor Deng Zhenglai.
