| 摘 要： | 侵犯商业秘密罪是侵犯商业秘密,给权利人造成重大损失的行为,其构成应符合主观和客观要件。损失额的确认,首先须确定损失的范围,其次要采取正确的计算方法。侵犯商业秘密罪的方法行为不应与本罪数罪并罚。犯罪行为类型、方式、手段不同,量刑时就应采用不同的刑种或刑罚幅度。

The differences in the types, manners and means of infringing acts determine the types of crime or the extent punishment . |
