罗马法中法律解释权的配置探析

与罗马法受到高度关注形成鲜明对比的是,罗马法中法律解释权的配置问题没有受到应有的重视。根据罗马法的分期来归纳,其法律解释权的配置状况可以概括为：王政时期与共和国前期僧侣团掌握法律解释权,共和国后期法学家实际上拥有法律解释权,帝政前期法学家公开掌握法律解释权,帝政后期法律解释权由法学家转至皇帝。罗马的司法者一度拥有法律解释权。纵观罗马法中法律解释权配置的演变可以看出,罗马法的发展与法学家掌握解释权具有相生相长的关系。

Discussion on Distribution of Roman Law's Power of Legal Interpretation

In sharp contrast with high level concern about Roman law,the distribution of Roman law＇s power of legal interpretation has not been given due attention.According to different stages of Roman law,it can be generalized as：monk group controlling the power of legal interpretation during Roman Kingdom and early Roman republic period/ jurists actually having that power in inconspicuous way during late republic period/ early Roman Empire jurists having that power in public/ late Roman Empire that power was in charged by the empire instead of jurists.The judiciary had the power of legal interpretation for a time.We can know from the general survey of evolution of the power of legal interpretation：there is a tight connection between the development of Roman law and jurists who had the power of legal interpretation.
