摘    要:国内外多数学者认为商品化权是一种新型的知识产权,但知识产权体系其实无法包容商品化权。商品化权具有无形财产权的品性,即使是人格因素商品化权也不例外。只有在无形财产权范畴中才能准确把握商品化权的性质。

Abstract:A great number of scholars inside and outside our country think that merchandising right is a new kind of intellectual property,but in fact merchandising right can't be included in such a system.Merchandising right bears the attributes of intangible property,even personality merchandising is not an exception.Only in the category of intangible property can we grasp the nature of merchandising right accurately.
