| 摘 要： | 关于片面共犯的存在与否及其性质 ,刑法理论上争议较大。本文认为片面共犯作为一种客观现象应当肯定它的存在 ,但片面共犯又不同于共同犯罪、间接正犯 ,它是一种独立的犯罪类型 ,应当在刑法中单独对其作出规定。只有片面帮助犯才能成立片面共犯

| Abstract: | There is much argument about existence and qua li ty of one sided accomplice in the theory of Criminal law.The article holds that as a kind of objective phenomenon,the existence of one sised accomplice must be confirmed.But one sided accomplice is an independent category of crime,which is different from accomplice,indirect principal,It should be separately prescribed in criminal law,only one sided accessory constitutes one sided accomplice. |
