| 摘 要： | 危险通知义务包括保险事故发生前的危险增加通知义务与保险事故发生后的出险通知义务.其目的在于使掌握信息优势的投保方将危险变动情况及时通知保险人,实现双方的利益平衡与交易公平.从危险通知义务的履行条件、履行主体、履行方式、履行期限以及怠于履行此义务的法律后果等方面进行探讨,以期完善我国保险立法.

| Abstract: | Duty of notification of risk,which includes the duty of notification of increasing risk and the duty of notification of the occurring of insurance accident,is to notify the insurer of the alternation of risk in time.To amend the Chinese insurance legislation,this paper concentrates on the study of conditions of performance,subjects of performance,means of performance,deadline for performance and the legal effect of policyholder's insurance legislation. |
