澳门葡据时期侦查体制研究

1553年，葡萄牙人始定居于澳门，此一时期，欧陆的司法制度引入澳门。除因“移民”所带来的法律移植以外，还保留了传统中国的刑事对策。由于葡萄牙殖民者“始领澳”（1553年）时正值欧洲中世纪晚期。所以，澳门葡据时期的侦查体制也承继了欧陆中世纪法律，这是殖民地侦查体制中一个独有的现象。澳门经过漫长的法制演进，逐渐形成了以“华夷分治”和“葡华分治”为代表的二元式侦查体制。

A Study on the Investigation System During Macao Occupied by Portugal

Portuguese settled in Macao in 1553. At the same time, the European judicial system first introduced in Macao. The traditional criminal countermeasures of China were retained, except for the legal transplantation brought by the ＂migrates＂. It was the late middle ages in Europe that the Portuguese colonists ＂occupied Macao＂ （in 1553）. Therefore, the investigation system also inherited the European medieval law. This is a unique phenomenon in the investigation system of colonies. Through a long history process of gradual progress, Macao has been gradually forming binary investigation system represented by ＂Chinese and foreigners governing separately＂ and ＂Portuguese and Chinese governing separately＂.
