| 摘 要： | 认定企业法人名称权为人格权已演变为学界的思维定势 ,但人格权无力载负企业法人名称权所具有的直接厚重的财产利益 ,兼出自企业法人名称权特征及迎合国际潮流的考虑 ,宜将企业法人名称权纳入知识产权领域给予对待。企业法人名称权可否继承 ?这个问题其实并不复杂。可是有些学者偏偏混淆了企业法人名称权的主体 ,抹杀了企业法人名称与企业法人名称权的分界 ,以致得出不适当的判断 ,因而还是有探讨必要的。
