治安行政案件辨认规则及程序研究

治安行政案件辨认是公安机关及其人民警察办理治安行政案件常用的一种调查取证方法。当前,治安行政案件辨认存在的主要问题是主观上证据意识不够强、客观上辨认条件有限、程序上辨认规则难以落实、辨认笔录记录的内容不科学。治安行政案件辨认程序主要应当做好辨认准备、辨认实施、辨认笔录、辨认结果审查等四个方面的工作。公安机关及其人民警察要不断提高执法水平和质量,严格依法进行辨认,杜绝违法辨认现象发生。
