| 摘 要： | 权利是民法的核心与基石.尽管权利概念的理论众说纷纭,但均以某个要素或属性来对权利进行概括,各自仅代表着权利的某个层面或领域,无法统一和包含其他要素,因而都不能全面反映权利的内在本质.要全面正确地理解权利,更为关键的是把握权利的要素、探讨权利本质.而权利的基本要素主要包含利益、自由与意志;权利的本质则是社会关系的反映,是一种合法的不平等,是正当的事物.
