法治精神与公安法治

法治精神是一个多角度、多层次的概念,如果从管理、自由、民主和信仰等角度看,法治精神的内容有时可能发生矛盾。公安法治从总体上看,属于法治体系的组成部分,而从分类的角度看,属于管理意义上的法治,公安法治在运行过程中因其立足于管理者视角,因而也可能与其他的法治精神发生某种冲突。这主要应从公权与私权、主动与被动两个方面予以解决。

The Spirit of Constitutionality and Public Security Constitutionality

The author expresses the spirit of constitutionality as a multi-angle and multi-level concept. Judging from the aspects of administration, freedom, democracy and religion, its contents may fall into conflicts with each other. Generally speaking, public security constitutionality belongs to the administrative constitutionality. It is based on the angles of administrators, hence, it may conflict with other contents of the spirit of constitutionality. This thesis mainly discusses the conflicts and proposes a solution from two aspects.
