论我国代位继承制度

我国继承法一方面在某些方面体现了中国大陆的特色,同时我们也能感到,在某些方面,比如我国继承法在设计法定继承制度时,受到前苏联继承法的影响,以及当时中国特殊国情的影响,在一定程度上使继承制度人为地具有了社会保障的功能。这在一定程度上导致了对死者意志的不够尊重。随着我国公民财产数量不断增多,财产表现形式日趋丰富,加之中国内外部环境发生了日新月异的发展,且大陆地区社会保障制度也在逐步健全,这就需要我们重新审视我国的财产法定继承制度。本文试图立足于法定继承应该尽可能充分表达被继承人的意愿,从而在意思自治的基点上讨论法定继承制度的相关问题。

On succession by subrogation in China

Though the Succession Law of our country exhibits its own characteristics,we still have the sense that because of the influence of the Succession Law of the former Soviet Union and the limitations of the situation then in China,our Succession System was artificially made to shoulder the responsibility of social security at some respects and to some degree.This to some degree leads to less respect to the will of decedent.At present,private property of Chinese people is greatly increasing and people's property takes on various forms.Meanwhile,the situation has greatly changed home and abroad,At the same time,the social security system on mainland is being improved.As a result,we need to carefully examine our Statutory Succession System from the new perspective.On the basis of the principle of will autonomy,the author tries to discuss some issues of Statutory Succession and thinks that decedent's will must be fully respected.
