“两个证据规定”实施情况调研报告——侧重于三项规定的研究

"两个证据规定"承载着社会各界对完善刑事证据制度、推进公正审判的热切期望,自2010年7月1日实施以来,其实施状况颇为引人关注。本文以四个中级人民法院为研究对象,对中院适用"两个证据规定"的情况进行了调研,通过运用访谈、阅卷等实证研究方法开展研究。就研究主题而言,选取了"两个证据规定"中的三项规定进行重点研究,其分别是非法证据排除规定、隐蔽性证据的使用问题以及特殊侦查措施取得的证据的使用问题。

Filed Research Report on the Implementation Status of the Two Evidence Acts Research Focusing onThree Provisions.

The two evidence acts supports the eager expectations of perfecting the criminal evidence system and boosting fair trial of the public.The implementation status has been being remarkable since its implementation from July 1,2010.This paper takes four intermediate people′s courts as research objects,and makes an investigation of the implementation status of the two evidence acts.The empirical research methods include interview,case files review and so on.As for the theme,it focuses on three provisions: the exclusion of illegal evidence,the use of covert evidence and the use of special investigation evidence.
