| 摘 要： | 本文以权利和程序为切入点,通过对黄静诉华硕名誉侵权这一热点案件进行了法理分析本案是在华硕及黄静的行为均不构成权利滥用的情况下,由于名誉权与言论自由权之间的权利边界不明确而引发的权利冲突,在此基础上着重对解决本案的程序性问题进行了探讨。

| Abstract: | The rights and procedures for the entry point in this paper,helding a preliminary jurisprudential research on the hot case of Huangjing v.ASUS reputation tort.The actc of ASUS and Huangjing does not constitute a right to abuse,however,as the rights to reputation and freedom of expression are not clear boundaries arising from the conflict,and especially analyzes the procedural requirements solving this tort case. |
