罪犯个案矫正实质论

罪犯个案矫正的正当性依据是行刑个别化,而行刑个别化是刑法基本原则和本质的具体化。刑事实证学派将刑罚关注的中心集中在刑罚的矫正功能,使刑罚的个别预防走上历史的舞台,把犯罪人作为犯罪预防的重点。同质主义认识论认为,一种主观恶习和客观危害行为是统一的本质问题。监狱的行刑,必须通过强制的改造,才能转变罪犯的主观恶性,才能转变罪犯的本质。多元认识论构架下的罪犯个案矫正认为,罪犯在服刑期间产生的心理危险,可能与其原有的引起犯罪行为的犯因性问题有着密切的关联性,是其前发性问题的延伸,但也可能是受服刑期间的变量影响而形成多样性的新的问题。
