| 摘 要： | 辩诉交易作为一个典型的舶来制度能否中国化的问题,需要结合中国国情进行缜密考察。司法制度之树生长的土壤、环境不同,移植就应当慎之又慎,否则,其效果可能是南橘北枳,食洋不化。辩诉交易制度的运行环境、文化基础和配套措施都和中国的法律有较大差异,因此目前引进辩诉交易制度是不理智也是不现实的。

| Abstract: | As a typical exotic system, the Chinalization of plea-bargaining is a problem that needs to be studied with the situation of our country. If the judicial tree grows in the different soil, the transplantation of it should be done cautiously. Otherwise, the effect would be far from expectation. This article emphatically discusses the running environment of the plea-bargaining system and elementarily analyzes the feasibility of transplanting it with Chinese legal system and the deeper judicial idea integrated by current Chinese legal norms as well. |
