| 摘 要： | 我国现有的法律救济制度中,传统的民事救济和行政救济,由于制度的缺陷和环境侵权自身的特点,使受害者损失仍弥补不足,社会救济制度正是作为环境损害填补的社会化保障制度之一应运而生.文章从该制度的含义和性质入手,分析了设立该制度的现实和理论原因,并从制度的具体操作层面提出了一些建议.

| Abstract: | In our current legal relieving system of environmental tort, the traditional common civil relieving system and the administrative relieving system have their limitations. The specialty of environment tort determine to the insufficient of victim compensation. This article introduces the meaning and nature of the system, and then analyzes the theory which the relieving system rests on. In the end, proposes suggests to the operate of the system. |
