| 摘 要： | 由于共同犯罪停止形态在刑法上缺乏统一的规定,使得共同犯罪停止形态的认定不可避免的复杂化。本文试从片面共犯的解除、共犯关系的解除和在共同犯罪中存在着共犯意思的阶段性三个方面来阐述在同一个共同犯罪中存在诸多不同形态的合理性。
