惩罚与改造的关系新探

惩罚与改造是我国监狱语境中使用频率最多的词语。二者既有区别又有联系。其区别表现在行为的直接动机、行为的具体方式、行为的主体范围、行为的法律保障、行为的结果要求等方面均不同。但是,二者在最终目标上具有同向性,时空条件上具有一致性,功能发挥上具有互补性,资源利用上具有同一性等。通过对这一问题的研究,对我国监狱职能体系及其结构做出一个科学的定位,正确理解与科学把握惩罚与改造这一独立的监狱职能。

Research on Relation between the Penalty and Transformation

＂Penalty＂ and ＂transformation＂ are glossaries with the most use in jail linguistic environment in our country.The two have the difference and the relation at the same time.Its difference displays in direct motivation of the behavior,concrete way of the behavior,the main body scope of the behavior,behavior legal safeguard,behavior aspects,result request,and so on.But the two have the same tropism in the ultimate objective,in the space and time condition has the uniformity,in the function display has the complementarity,in the resources use has identically,and so on.Through research on this problem,we can make a scientific localization to jail function system and the structure in our country,correctly understand and scientificly assurance the independent jail function of penalty and transformation.
